Terms of Use

These terms are an agreement between you and JCOM LLC, a limited liability company registered in Wyoming, United States, with its address at 1309 Coffeen Avenue STE 1200, Sheridan, Wyoming 82801, United States ("we", "us"), for the Notahop app. By installing or using the app you accept them. Apple's standard Licensed Application End User License Agreement also applies; where the two differ, these terms apply.

1. The app

Notahop is a game for practising reading music notes on the treble, bass and alto clef. It is a practice tool and does not replace a music teacher, lessons or exams.

2. Progress and your responsibility

• Your progress is stored on your device (see the Privacy Policy). It is lost if the app is deleted, unless it was saved in a backup of the device.
• Points, levels, stars and ranks reflect practice in the app only.

3. Ranks

• You appear on the ranks under a nickname you type, which we check before other players see it, and a country flag. You can switch this off in Me with "Show me on the ranks".
• Pick a nickname that does not say who you are or where you live, and nothing rude. We may refuse or remove any nickname.
• Ranks are for fun. We may correct or remove scores that are clearly not from normal play, and we may change how points are counted. Don't try to get around the limits of the ranks, for example by sending made-up scores.

4. Price and Notahop Unlimited

• Notahop can be downloaded and played without paying: you get two free rounds, which refill 3 hours after the last one. Every clef, every level, the ranks and all outfits are part of the free game. There are no ads.
• Notahop Unlimited is optional and gives unlimited rounds. It is offered as an auto-renewing yearly subscription that starts with a 3-day free trial, an auto-renewing monthly subscription, or a one-time lifetime purchase. Prices are shown in the app before you buy, in your local currency, and may change; changes never affect a period you have already paid for.
• Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period. Payment is charged to your Apple ID account. Manage or cancel any time in iOS Settings → Apple ID → Subscriptions. Free trials, where offered, convert to a paid subscription unless cancelled before the trial ends.
• Refunds are handled by Apple under Apple's policies; we cannot issue refunds directly.
• Restore Notahop Unlimited on another device or after reinstalling with "Restore purchases" in Me, using the same Apple Account.

5. Acceptable use

Don't reverse-engineer, resell or misuse the app, and don't use it to break any law. That's it.

6. Availability and changes

We work hard to keep the app reliable, but we can't promise it will be free of errors or available at all times. We may add, change or remove features, and may stop offering the app; if a paid feature is removed we will make reasonable efforts to inform you.

7. Disclaimer and limitation of liability

The app is provided "as is" without warranties of any kind, to the extent permitted by law. To the fullest extent permitted by law, JCOM LLC is not liable for indirect, incidental or consequential damages, or for lost progress or data arising from use of the app. Our total liability for any claim is limited to the amount you paid us in the twelve months before the claim. Nothing in these terms limits rights that consumer law gives you and that cannot be limited.

8. Governing law

These terms are governed by the laws of the State of Wyoming, United States, without regard to its conflict-of-law rules. Any dispute arising from these terms or the app will be handled by the state or federal courts located in Sheridan County, Wyoming, and you consent to their jurisdiction. This does not affect mandatory consumer protections you have under the law of your country of residence. If you are a consumer in the European Union or the United Kingdom, you may also bring a claim in the courts of the country where you live.

9. Third-party beneficiary

Apple Inc. and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you. Apple has no obligation to provide maintenance or support for the app; if the app fails to conform to any applicable warranty you may notify Apple and Apple may refund the purchase price, but Apple has no other warranty obligation. Apple is not responsible for addressing any claims relating to the app, including product liability, legal or regulatory compliance, and consumer protection or intellectual property claims.
